Terms of service.

The terms that apply to this site and to Kirk One.

1. About these terms

These terms govern your use of kirk-co.com and Kirk One, the Kirk & Co. CRM and client portal application, operated by Kirk & Co. L.L.C., an Indiana limited liability company. Website design and related services are provided by Kirk Web Design under its own terms.

2. Using this site

You may read and share this site. Do not attempt to gain unauthorized access, disrupt it, scrape it at a volume that degrades service, or use it to break the law.

3. Kirk One accounts

Kirk One is in active beta. Creating an account reserves an isolated Kirk One workspace. The workspace opens, and the seven-day trial begins, when you complete Stripe-hosted Checkout. Features, trial availability, and beta access may change as the product develops. You are responsible for keeping credentials confidential and for activity under your account. Tell us promptly if you believe an account has been compromised.

4. Your data in the CRM

Information you enter remains yours. We access it to operate, support and improve the service. We do not sell it. You can request an export or deletion of data we are not required to retain.

5. Availability

We aim to keep the service running and take reasonable care with backups, but Kirk One is offered without an uptime guarantee or service-level commitment. Maintenance and interruptions can occur.

6. Fees

At signup, you choose either Starter at $49 per month or $449 per year, or Premium at $79 per month or $699 per year, and enter a payment method in Stripe-hosted Checkout. Nothing is charged when the seven-day trial begins, and we email you three days before it ends. Unless you cancel before the trial ends, Stripe automatically charges the selected price after the trial and then each month or each year, as selected, until canceled. A promotional code, when one is offered, reduces the price as described with that offer; a code offered as lasting for as long as you stay subscribed ends if the subscription is canceled. To cancel, choose Cancel plan under Settings, Billing in Kirk One, or email kirk@kirk-co.com, before the next renewal. Cancellation stops future renewals; you keep access until the end of the trial or the period already paid for, and fees already paid are not refunded. Stripe stores and processes the payment method; Kirk & Co. does not receive or store your full card number.

7. Intellectual property

The site, the software, the Kirk & Co. and Kirk One names, and their design and code are owned by Kirk & Co. L.L.C. Nothing here transfers ownership of them to you.

8. Warranties

The site and the service are provided “as is” without warranties of any kind, to the extent permitted by law. Content on this site is general information, not professional advice.

9. Limitation of liability

To the extent permitted by law, Kirk & Co. L.L.C. is not liable for indirect, incidental or consequential damages, or for lost profits or lost data, arising from use of this site or the service.

10. Changes

We may update these terms; the date above will change when we do. Continued use after an update means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules.
